TERMS OF SERVICE

1. INTRODUCTION

These Terms of Service (“Terms”) constitute a legally binding agreement between you and SEIN Błażej Adamczyk, operating under the trademark Sein Digital (“we,” “our,” or “us”), located at Magnacka 5/3, Warsaw, Mazovian, Poland, governing your access to and use of our mobile applications, games, and related services (collectively, the “Services”).

By downloading, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. ELIGIBILITY

You must be at least 13 years old to use our Services. Some of our Services are intended for users aged 18 and older, as indicated in the app description or within the app itself. By using our Services, you represent and warrant that you meet the applicable age requirements.

3. LICENSE TO USE OUR SERVICES

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use our Services for your personal, non-commercial use on compatible devices that you own or control.

4. PROHIBITED CONDUCT

When using our Services, you agree NOT to:

a) Use cheats, automation software, hacks, bots, mods, or any unauthorized third-party software designed to modify or interfere with the Services;

b) Engage in data scraping, data mining, or any other practices aimed at collecting data from our Services beyond their intended functionality;

c) Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of our Services;

d) Use the Services for any illegal purpose, or in violation of any local, state, national, or international law;

e) Attempt to gain unauthorized access to our Services, user accounts, or computer systems;

f) Interfere with or disrupt the integrity or performance of the Services;

g) Create multiple accounts for abusive purposes;

h) Sell, transfer, or share your account or account access credentials;

i) Use the Services in any manner that could disable, overburden, damage, or impair the Services;

j) Use any robot, spider, or other automatic device to access the Services;

k) Introduce any viruses, trojan horses, worms, logic bombs, or other harmful material to the Services.

5. USER CONTENT

If our Services allow you to post, upload, or submit content (“User Content”), you retain all rights in your User Content, and you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Services.

All User Content must be in English and must comply with platform content requirements, including but not limited to:

a) No pornographic, obscene, or sexually explicit material;

b) No profanity or offensive language;

c) No content that promotes discrimination, racism, or hatred;

d) No content that infringes on intellectual property rights;

e) No content that is defamatory, libelous, threatening, or harassing.

For games marked as 18+, there may be some leeway regarding mature themes within the boundaries of what is permissible under applicable laws and platform guidelines.

We reserve the right to remove any User Content that violates these Terms or that we determine is harmful, offensive, or otherwise objectionable.

Paid content is locked to the device or account on which it was purchased. While we permit limited account sharing among family members and small groups of friends, the following restrictions apply:

a) You may not sell, rent, lease, or otherwise commercialize access to your account;

b) You remain responsible for all activities that occur under your account;

c) You may not share content that is not permissible under these Terms;

d) You may not share accounts for the purpose of circumventing territorial restrictions or payment requirements.

7. PURCHASES AND PAYMENTS

If you choose to make a purchase within our Services, you agree to pay all fees and applicable taxes incurred by you or anyone using your account. All purchases are final and non-refundable, except as required by applicable law.

For users in the European Union, you have the right to withdraw from a purchase within 14 days of the purchase without giving any reason, except where:

a) The digital content has been fully delivered with your prior express consent and acknowledgment that you thereby lose your right of withdrawal; or

b) The performance of services has begun with your prior express consent and acknowledgment that you thereby lose your right of withdrawal once the service is fully performed.

8. INTELLECTUAL PROPERTY

Our Services, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.

9. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless SEIN Błażej Adamczyk, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

12. TERMINATION

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Specifically, we may terminate your access if:

a) You sell or attempt to sell access to your account;

b) You share content that is not permissible under these Terms;

c) You engage in any of the prohibited conduct listed in Section 4;

d) We are required to do so by law;

e) The provision of the Services to you is, in our opinion, no longer commercially viable.

Upon termination, your right to use the Services will immediately cease.

13. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Poland for the resolution of any disputes arising from these Terms or your use of the Services.

For consumers residing in the European Union, these Terms do not affect your statutory rights as a consumer and shall be interpreted and enforced in accordance with the mandatory consumer protection laws of your country of residence.

14. DISPUTE RESOLUTION

In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms or the breach thereof, you and we shall use our best efforts to settle the dispute, claim, question, or disagreement. If no resolution is reached within 60 days, the dispute shall be resolved in accordance with Polish and EU law.

15. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or by posting a notice through our Services prior to the changes becoming effective. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

16. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding our Services, and supersede and replace any prior agreements we might have had between us regarding the Services.

19. CONSUMER RIGHTS NOTICE FOR EUROPEAN USERS

If you are a consumer residing in the European Union, you have certain rights under EU consumer law, including:

The right to a 14-day withdrawal period for digital content not yet supplied;
The right to receive goods and services conforming to their description;
The right to certain remedies for lack of conformity; and
The right to fair and transparent contract terms.

Nothing in these Terms is intended to affect these statutory rights.
